Currently the United States Congress has allowed a "sundown"
provision in Chapter 12 to become effective. Since July of 2000, the
bankruptcy courts lack jurisdiction over Chapter 12. Renewal is probable,
but has been tied to major bankruptcy reform that was vetoed by former President
Clinton.
In other words, Chapter 12 is not available today. In all
likelihood, it will be made available sometime during the year 2002.
